terms and conditions of the guarantee
1. CLIENT hereby confirms that it has analysed the performance of the Carrier Transicold Europe (hereinafter referred to as C.T.E.) equipment and considers it suitable for its needs and waives any dispute regarding the performance of the aggregate and the operation of the aggregate.
2. The aggregate of the general warranty is for 1 (one) year or 1000 (thousand) working hours (whichever comes first). Warranties can be purchased for up to 2 years.
3. The general guarantee does not cover the first 400 hours of compulsory maintenance.
4. The date of first registration on the vehicle’s registration certificate is also the date of commencement of the guarantee.
5. The warranty does not apply to used equipment, unless otherwise stated.
6. Proof of a design defect or deficiency must be provided by the CLIENT.
7. The C.T.E. warranty covers repairs and replacement of defective parts with new parts.
8. The guarantee covers work carried out in C.T.E. workshops or in workshops of C.T.E. approved repair centres, during working days and normal working hours. The warranty does not cover additional costs incurred for work ordered by CLIENT outside C.T.E. workshops and/or outside normal working hours. These costs are borne by the CLIENT.
9. Replacement parts under warranty remain the property of C.T.E..
10. Replacement parts inspected, replaced and repaired under warranty do not extend the warranty period of the equipment.
11. The warranty does not in any way justify delays in the payment of invoice(s) for the equipment, spare parts and maintenance and repair work. Any breach of the payment contract renders the guarantee void ipso jure.
12. Failure to comply with the compulsory maintenance schedule will invalidate the warranty.
13. If the CLIENT or CLIENT’s employee asks an employee of C.T.E. to drive the vehicle, C.T.E. shall not be liable for any accidents that may occur. Whether they are related to driving or accidents involving third parties.
14. Visible defects and claims for defective or missing parts must be submitted to the authorised representative of C.T.E. within one week from the date of receipt of the goods and/or the vehicle, otherwise the aforementioned defects will not be reimbursed.
15.The C.T.E.warranty does not cover under any circumstances:
15.1 obsolescence or damage to the equipment due to inadequate service, misuse, accident, abnormal or harmful use or normal wear and tear,
15.2 depreciation cost of equipment
15.3 direct or indirect damage to persons and/or goods transported as a result of accidents.
15.4 In the event of unauthorised modification, transformation or repair of the refrigeration appliance, without the prior written consent of C.T.E., by a third party.
15.5 The serial number of the device is illegible, corrupted or removed.
15.6 Direct Drive units without C.T.E. compressor, compressor crown and/or installation kit.
15.7 Normal external influences, vibration, wear and tear (e.g. paint fading or fading).
15.8 The cost of routine maintenance (e.g. engine adjustment, fluid and filter changes, lubrication, cleaning and polishing, replacement of fusible protection, etc.) is normally borne by the owner of the unit. In the event that these repairs are necessary as part of a warranty repair, the warranty will also cover them.
15.9 Failures occurring on an aggregate whose operating hours readings have been modified.
15.10 Damage to an aggregate declared destroyed or totally damaged by a financial institution or insurer.
15.11 Costs of loss of income, transport, telephone and accommodation incurred by the owner or user of the equipment and costs of loss of staff or property.
15.12 Damage or breakdown caused directly or indirectly by:
- fire, vandalism, accident or theft;
- misuse or negligence;
- repairs carried out by a repairer other than a C.T.E. authorised repairer;
- the fitting of spare parts which are not original C.T.E. parts or parts of equivalent quality;
- lack of maintenance, including the use of fluids not mentioned in the owner’s manual or the quick reference guide.
